This section sets out the terms of use for all Hodder & Stoughton websites.  References to "we" and "us" are to Hodder & Stoughton.

By using any of our websites you acknowledge that you have read, understood and agree to be bound by these terms. We may update these terms and any other legal notice on our websites (including the privacy policy) without the consent of any other person.  All changes will be effective when posted on our websites and you will be bound by any new terms when you visit our websites. If you do not agree to these terms (including any amendments) you must not use our websites.

Rights

You acknowledge that all rights in our websites and their contents (including but not limited to text, photographs, graphics, and downloads) are owned by or have been licensed to us or are otherwise used by us as permitted by applicable law. In accessing our websites you agree that you will access the contents solely for your own personal, non-commercial use and you acknowledge that you are not permitted to copy, download, store in any medium (including any other website), distribute, transmit, modify or show in public any part of our websites without our prior written permission or in accordance with the Copyright, Designs and Patents Act 1988.

Competitions

By entering this competition you agree to be bound by the following Terms and Conditions:
No purchase necessary. This competition is open to all UK residents aged 18 or over except those who are employees of The Promoter or other companies involved directly with the administration of this competition or any member of their households.
There is a limit of one entry per household.  Proof of entering is not proof of receipt of entry.
Entries must be received by the stated closing date.  The Promoter accepts no responsibility for any entries that fail to reach the Promoter by the relevant closing date for any reason.
There are no cash alternatives.
The winners will be drawn at random from the correct entries within 14 days of the promotion closing date.
The winners will be notified by email within 14 days of the promotion closing date and are required to accept their prize by email within 14 days of notification. If no acceptance is received within the specified period, the promoter reserves the right to reallocate the prize to the next randomly drawn correct and valid entry.   The promoter’s decision is final and no correspondence, apart from notification, will be entered into.
The names of the winners will be available after the prizes have been allocated and accepted,  and can be obtained by sending a SAE to the competition address: Website Competition, Hodder and Stoughton Competitions, Marketing Department, 338 Euston Road, London NW1 3BH.
The winners agree to take part in reasonable post event publicity and to their name and photograph being used for promotional purposes.
Copyright in all material submitted as entries rests with the promoter.

These terms and conditions of sale

These terms and conditions (the "Terms") govern any orders placed using and purchases made in connection with the Website. Please read these Terms carefully. You agree to be bound by these Terms by placing orders using and/or by making purchases in connection with the Website. Do not place orders using or make purchases in connection with the Website if you do not agree to these Terms. Nothing in these Terms affects your statutory rights.

The Website and the information contained on it may be supplemented, removed, changed and/or updated without notice to you. We may revise these Terms and any other legal notice on the Website (including the Terms Of Use and Privacy Policy) without notice to you. All changes will be effective when posted on the Website and you should check the Website from time to time to review these Terms and other legal notices because they are binding on you.

Your responsibilities

By placing an order using and/or by making a purchase in connection with the Website, you warrant to us that you are legally capable of entering into a binding contract with us in the country in which you are located. You are solely responsible for ensuring that the details that you provide are correct and complete and for informing us of any changes to them.

You will only use the Website in accordance with our Terms of Use

Ordering

Bookpoint is responsible for processing any orders for print and audio books placed using or purchased in connection with the Website.

To select products to order, simply click on the order button against the appropriate book title. Use the shopping basket to select further titles and see the contents of your shopping basket. When you have finished shopping, please click on 'Continue to Order'.

If you are a returning customer you will be asked to sign in here; if you are a new customer, you will be asked to register. You will need to enter your email address and set a password (and password reminder) in order to do this.

If you are a returning customer who chose last time to have your details saved, all you need to do now is select a shipping option for your saved delivery address, click 'Continue to order'; then enter your credit card verification code (which, for security, is never saved) and click 'Continue to order'. Check all the details of your order (if you need to change anything, click any of the 'Edit' buttons next to the component you need to change). Click 'Place order now' to place your order.

If you are a new customer, you will need to fill in billing address, shipping address (which you can copy from billing address with a single click), shipping option (see delivery charges), and credit card details. In Options and Preferences, you will also be able to determine whether your details are saved for your next visit, and whether you wish to be contacted for marketing purposes.

You can save multiple shipping addresses and credit card details by simply entering a new address or new credit card details as required. At your next visit you will have the option to select from previously used details.

Your account

Once you have set up an account by ordering a book, your account details will be kept securely on our system if you have chosen for us to do so. All you need to do is click on 'your account', and then log in by entering your email address and password. If you have forgotten your password, click on 'Email reminder' to receive your password reminder or 'Email replacement' if you don't have a reminder or if it fails to remind you of your password.

When you sign in to your Account page, you can edit or delete saved billing and delivery addresses, credit card details and you can change options and preferences.

What are my payment options?

As well as card type, you will need to fill in your credit card number, expiry date, and the name and address of the card holder. You may be asked for the CSC code, this is the final three digits of the long number on the signature strip on the back of your card.

We also accept payment by Maestro (debit card).

As well as card type, you will need to fill in your card number, name and address of the card holder, expiry date, and, if you have one, start date and issue number. (NOTE: Some Maestro cards may not have a start date or issue number. If yours does not, simply leave this field blank).

Safe shopping

We take your online privacy seriously. We have a security certificate issued by Verisign. However, the security of any payments transmitted and processed via the internet cannot be guaranteed. Any losses incurred or sustained by you as a result of transmitting information by means of email or other internet link will be borne solely and exclusively by you.

Prices

The prices shown are only applicable to orders placed using or purchases made in connection with the Website. All prices are inclusive of UK taxes but exclusive of delivery charges.

Every effort is made to ensure that all prices are correct at time of display online. In the unlikely event of an administrative error resulting in an incorrect price being displayed on the Website, we reserve the right to correct the price. Where we discover an error in the price of any product that you have ordered or purchased, we will not be obliged to proceed with your order and we will usually endeavour to inform you of the error and the correct price as soon as possible. In these circumstances, you will not be bound to continue with your purchase, and we will usually endeavour to ask you to send an email (where you had placed an online order) or a letter (where you placed an order with us using any other method) to us to confirm that you wish to proceed at the corrected price within a stated time. In the event that you reply that you do not wish to proceed at the corrected price, or do not reply within the stated time or if we are unable to contact you, then we will cancel the order or purchase and refund the amount paid by you. In no circumstances will we be obliged to proceed with your order or purchase at an incorrect price, even if we have accepted your order for a product displayed at the incorrect price and/or failed to inform you of the error.

Special Offers

From time to time we may run special offers. These are available for limited times only. We reserve the right to withdraw the special offer or change any of the terms (including the availability and end date) of the special offer at any time without notice to you.

Out of stock titles

We are unable to accept orders for products that are out of stock. Any orders placed for products that are out of stock will be cancelled and any amounts paid in respect of those products will be refunded. No substitute products will be offered in place of any out of stock products ordered. Please check back at the site at a later date to see if the product has become available.

Acknowledging your order

Once you have placed your order with us, Bookpoint will acknowledge the receipt of your order by sending either an email (in the case of an online order) or a letter by post (in the case of any other method by which your order was placed) to you using the address you supplied when placing your order with us.

Amending your order

If you need to amend your order please contact Bookpoint by telephoning 01235 827702 Monday to Friday, between the hours of 9am and 5pm, or by sending an email to mailorder@bookpoint.co.uk.

Delivery

We can deliver to any address in the United Kingdom. Delivery to a UK address is free.

Once we have sent an order confirmation to you, we will endeavour to deliver the product(s) covered by it to the UK delivery address entered by you within five working days. However, all delivery times are estimates only, and while we will do everything we can to deliver your products within this time frame, we will not be liable to you for any loss or damage arising from delay in delivery.

We may deliver the products in instalments. Delivery charges will be those set out at the time of your order.

International orders

Please note that we can only deliver products to countries in which we have the right to sell them. Where you intend to order a product to be delivered to an address outside the UK, please contact Bookpoint in advance by telephoning 01235 827702, Monday to Friday, between the hours of 9am and 5pm, or by sending an email to mailorder@bookpoint.co.uk to confirm that we can deliver the product to you. If you place an order for a product that we cannot deliver to you, then we will cancel the order and any amounts paid in respect of it will be refunded. No substitute products will be offered in place of any such products.

Once we have sent an order confirmation to you, we will endeavour to deliver any product set out in it to the delivery address entered by you within 30 calendar days of the date of that order confirmation.

We will not be liable to you for any loss or damage arising from delay in delivery. We may deliver the products in instalments. Delivery charges will be those set out at the time of your order.

You will be responsible for the payment of any import duties or taxes that are payable outside of the UK. You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Postage and packing charges

Currently we offer free post and package on all UK orders. This is liable to change and if so we will update the terms and conditions accordingly.

International orders postage costs are calculated at the point of order on the basis of weight of products ordered and you will be informed of the cost before you complete the transaction.

Risk and title

The products will be at your risk from the time of delivery. Ownership of the ordered products will only pass to you when we receive full payment of all amounts due in respect of the products purchased, including delivery charges.

Your consumer rights: cancelling your order

You may cancel your order before delivery or within 14 calendar days after the delivery date. In order to cancel your order you must notify Bookpoint in writing by sending an email to mailorder@bookpoint.co.uk or by sending a letter to Bookpoint Limited by post to:

Please ensure that you quote your order reference and identify the products which you want to cancel your order for.

You must return all cancelled products to us immediately in the same condition in which you received them and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

Upon receipt of your written cancellation notice and the return of any cancelled products already delivered to you, Bookpoint will process the refund due to you as soon as possible and, in any case, within 30 calendar days of the day you have given notice of your cancellation. In this case, we will refund the price of the cancelled product in full, including the cost of sending the products to you. However, you will be responsible for the cost of returning the item to us

Other returns

We hope that you are happy with your purchases but if you are unhappy with any product, you may return it to Bookpoint (at your expense) in its original condition within 14 working days and we will provide a full refund, including the delivery charges paid to deliver the product to you. If the reason for the return is the result of our error, of if the item was damaged before it reached you, we will also refund the package costs paid by you to return the product to us.

Our warranty and liability

We warrant to you that any product purchased from us through our Website is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

Our liability for any losses that you might suffer as a result of you placing an order for or making a purchase of products in connection with the Website is strictly limited to the combined purchase price of the relevant products that you have purchased. We exclude all liability and responsibility to you for all other loss or damage that you might suffer provided that this exclusion does not include or limit our liability for (i) death or personal injury caused by our negligence (ii) fraud or fraudulent misrepresentation or (iii) any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

Privacy

We will only use the personal data you supply us with in accordance with our Privacy Policy.

Force majeure

We shall not be liable for any loss, damage or otherwise as a direct or indirect result of the failure to perform or delay in performing any of our obligations nor shall there be a breach of these Terms as a result of the occurrence of any event whatsoever beyond our control, including without limitation acts of God, fire, flood, storm, civil disturbance, explosion, power failure or reduction of power supplies, acts, orders or requirements of any governmental or regulatory body, lack or shortage of materials, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks, adverse weather conditions, inability to procure or delay in procuring equipment and materials from our normal suppliers, mechanical breakdown or strike, lock-out or labour disputes.

Governing law

The Terms shall be governed by English law and you submit to the exclusive jurisdiction of the courts of England and Wales.

General

If any provision of the Terms is deemed unlawful, void or for any other reason unenforceable then that provision shall be deemed severed from the Terms and shall not affect the validity and enforceability of any remaining provisions.

Our failure to exercise or enforce any rights or any provision of the Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

The Terms are not intended to be enforceable by any person other than you and us (e.g. pursuant to the Contracts (Rights of Third Parties) Act 1999).

Links to other websites

Neither we nor any of our group companies are responsible for the content of any other website, including any website through which you may have gained access to any of our websites or to which you may gain access from any of our websites. We do not accept any liability in connection with such other websites or links.

General

Our websites and the information on them may be changed or updated without notice, unless we specify to the contrary. 

If all or any part of these terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Our failure to exercise or enforce any rights or any provision of these terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

The parties do not intend the terms (or any part of them) to be enforceable by any person who is not a party to these terms pursuant to the Contracts (Rights of Third Parties) Act 1999 except that Hodder & Stoughton may seek to rely on the benefit of these terms.  However, we may amend these terms without those other companies' consent and subsections 2(1)(a) to (c) of the Contract (Rights of Third Parties) Act 1999 shall not apply to these terms. 

Law and jurisdiction

Your use of our websites and downloads from them, and the operation of these terms, shall be governed in accordance with the laws of England and Wales. The English courts shall have the exclusive jurisdiction over any dispute arising out of your use of our websites except that we may take action in any jurisdiction to protect our intellectual property rights or to recover any amount owed to us.

International use

Those who choose to access our websites from locations outside the United Kingdom do so on their own initiative and are responsible for compliance with local laws.
